1. Eligibility

You must be at least 13 years old to use Hashpile. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the Service.

2. Account Registration

To use Hashpile, you must create an account by providing a valid email address and other required information. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

3. Service Description

Hashpile is an AI-powered service that generates shareable HTML cards from various inputs including text, images, and URLs. The Service allows you to:

• Generate HTML cards using AI models from multiple providers (including Anthropic, Google Gemini, Grok, and potentially others)
• Create multiple cards in a single session
• Share generated cards as images or URLs

The specific features, AI models, and capabilities of the Service may change over time at our discretion.

4. Subscription and Payment

Hashpile offers paid subscriptions and one-time credit purchases. By subscribing or purchasing credits, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate and complete payment information
• Authorize us to charge your payment method for all fees incurred

Subscriptions: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You may cancel your subscription at any time through your account settings.

Credits: One-time credit purchases are non-refundable and do not expire unless otherwise stated.

Refunds: All sales are final. We do not offer refunds except as required by applicable law or at our sole discretion.

Price Changes: We reserve the right to modify pricing at any time. Price changes will not affect existing subscription periods but will apply upon renewal.

5. Acceptable Use Policy

You agree to use Hashpile only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Generate, create, or share content that is harmful, illegal, violent, threatening, harassing, defamatory, or otherwise objectionable
• Use the Service to infringe upon intellectual property rights, including copyrights, trademarks, or patents
• Generate content that violates any applicable laws or regulations
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use automated systems (bots, scripts, etc.) to access the Service without our express written permission
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service to distribute spam, malware, or other malicious content

We reserve the right to investigate and take appropriate action against anyone who violates this Acceptable Use Policy, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

6. Intellectual Property and Content Ownership

Your Content: You retain full ownership of all content you input into Hashpile and all HTML cards generated by the Service. By using the Service, you grant us a limited, non-exclusive, worldwide license to process your input content solely for the purpose of providing the Service to you.

Generated Cards: All HTML cards generated through the Service are your property. You are free to use, modify, distribute, and commercialize them as you see fit.

Your Responsibility: You are solely responsible for ensuring that any content you submit to Hashpile (including text, images, URLs, or other materials) does not infringe upon any third-party intellectual property rights or violate any laws. We do not review, monitor, or verify the copyright status of materials you submit, and we assume no responsibility for copyright infringement or other legal violations arising from your use of the Service.

Our Service: The Hashpile platform, including its software, design, branding, and technology (excluding user-generated cards), is owned by Briefling AI and protected by copyright, trademark, and other intellectual property laws.

7. Third-Party AI Services

Hashpile utilizes AI models from third-party providers, including but not limited to Anthropic, Google Gemini, and Grok. Additional AI providers may be integrated in the future. By using the Service, you acknowledge that:

• Your inputs may be processed by these third-party AI services
• These third-party providers have their own terms of service and privacy policies
• We select and use AI providers at our discretion
• The specific AI model used for any given request may vary

Important: We do not use your submitted content or generated cards to train or improve AI models.

8. Data Collection and Storage

We collect and store the following information:

• Your email address for account registration and communication
• Messages and inputs you send to the AI models
• Generated HTML cards

Data Retention: User-generated cards are stored indefinitely for as long as the Service operates, unless you delete them through your account or request deletion. We reserve the right to delete inactive accounts and associated data after extended periods of inactivity.

9. Disclaimers and Limitations of Warranty

AS IS BASIS: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

AI-Generated Content: We do not guarantee the accuracy, completeness, reliability, or quality of HTML cards generated by the Service. AI-generated content may contain errors, inaccuracies, or inappropriate material. You are solely responsible for reviewing and verifying all generated content before use.

No Guarantees: We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service or servers are free of viruses or other harmful components
• Generated cards will meet your requirements or expectations

Service Availability: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRIEFLING AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any errors, inaccuracies, or omissions in AI-generated content
• Any copyright infringement or legal claims arising from your use of the Service or content you generate
• Any conduct or content of any third party on the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Briefling AI, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party, including intellectual property rights
• Content you submit to or generate through the Service
• Any copyright infringement claims related to your use of materials in the Service

12. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Requests by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease. We are not obligated to provide refunds for any unused subscription time or credits upon termination.

You may terminate your account at any time by contacting us or through your account settings.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this document and may notify you via email or through the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which Briefling AI is registered, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts located in the jurisdiction where Briefling AI is registered, and you consent to the exclusive jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Briefling AI regarding the use of the Service and supersede any prior agreements or understandings.
